Fiji's Penal Code replacedThursday, November 05, 2009
After 100 years of its existence, the Penal Code has been finally overhauled and we can even say – replaced with the Crimes Act. In a press conference this afternoon the Attorney General Aiyaz Sayed-Khaiyum revealed the new Crimes Act brings about some very ground breaking provisions into the criminal justice system. He says it modernizes and reforms the laws in Fiji and it makes Fiji compliant with many outstanding matters pertaining to our international obligations relating to CEDAW, the Convention on the rights of the child and the wrong statute. The AG also revealed that the jurisdiction of courts has been extended so that if a person from Fiji goes and commits a crime in some other country can be charged in Fiji. Sayed-Khaiyum says there have been some new offences pertaining to modern day communication that have also been included in the Crimes Act. Another new law is the Criminal Procedure Decree. Sayed-Khaiyum says they are looking at implementing the Decrees from the first of February, 2010 and until then the various law agencies in the country will undergo training.
